Wyoming County makes records available for public inspection that meet the generally outlined qualifications as set forth in Pennsylvania’s Right-To-Know Law (Act 3 of 2008).

Requests for public records can be made by completing and submitting the State’s Public Records Request Form.  All such “Right To Know” requests should be submitted to:

Wyoming County will reply to your request in the manner required by the Act.  If you have questions about open records, you can use the form on the left or call us at 570-996-2223

Fees.  Ask the Open Records Officer what your request will cost before you file — what you pay depends on the records and the format you ask for.  Whatever a county or state agency charges cannot be more than the Official RTKL Fee Schedule adopted by the Office of Open Records.  That schedule also says records sent to you by email may not carry an additional fee.

If your request is denied and relates to public records other than records relating to criminal investigations, appeals should be submitted to the Commonwealth of Pennsylvania, Office of Open Records, 555 Walnut Street, Suite 605, Harrisburg, PA 17101-1925.  These appeals will be heard by officers of the Office of Open Records.

The Office of Open Records accepts appeals four ways: online using its official OOR Appeal Form, which it recommends as the simplest way; by fax to 717-425-5343; by mail to the address above; or in person at that address during normal business hours.  There is no fee to file an appeal and you do not need a lawyer.

All appeals must be in writing, must state the grounds upon which the requestor asserts that the requested records is a public record, and must address any grounds stated by the County for delaying or denying the request.  All appeals must be filed within 15 business days of the mailing date of Wyoming County’s notice of denial or a deemed denial as defined in the Act.  All appeals will be handled in accordance with the Act.

On that last day, the cut-off time depends on how you file.  If you file online or by fax, you have until 11:59:59 p.m. on the 15th business day.  If you mail your appeal or bring it in person, it has to reach the Office of Open Records by 5:00 p.m. that day.  Mailing or hand-delivering gives you about seven hours less on the final day, and posting it on the last day will usually be too late.  If you are close to the deadline, file online or by fax.

Appeals about records that relate to a criminal investigation work differently.  The Office of Open Records cannot decide those.  Under Section 503(d)(2) of the Right-to-Know Law, they are heard by an appeals officer designated by the District Attorney of the county.  For records held by a Wyoming County agency, send that kind of appeal to the Wyoming County District Attorney’s Office, 1 Courthouse Square, Tunkhannock, PA 18657, (570) 836-4681.  The same 15 business day deadline applies.
